A Red Lake County Commissioner has been summonsed to appear in court for refusing to surrender office after changing residences.
According to the Red Lake County Sheriff’s Office, formal criminal complaint was filed Monday charging Charles Anthony Flage, 67, of Red Lake Falls with the gross misdemeanor crime of Non-surrender of Public Office.
According to the Sheriff’s Office report, “Flage is currently a Commissioner in Red Lake County, representing District Number 1. He was elected to that position on November 6th, 2018.” According to the criminal complaint posted by the Sheriff’s Office, Flange served as a County Commissioner representing District #4 from January 2015 through July of 2018
According to Red Lake County Sheriff Mitch Bernstein, Flange moved to another residence located in District number 1 of Red Lake County, but continued to serve as a County Commissioner for District number 4 for several months beginning in September of 2017.
Sheriff Bernstein says “the allegation is that he exercised the function of a public office when the right thereto had ceased, and he refused to surrender the office. In the midst of this investigation, Mr. Flage resigned from the Red Lake County Board of Commissioners, as the District number 4 representative, on July 1st 2018.”
Flage will be summonsed to appear, with his initial appearance scheduled for August 7th in Red Lake Falls.
