Bar and Restaurants may use some Rights of Way


Governor Tim Walz has authorized the Commissioner of Transportation to develop and implement a process to issue temporary permits to municipalities in Minnesota so they may allow bars and restaurants to use the right of way to conduct outdoor food and beverage services. Bar and restaurants would be able to use, with the proper permit, the streets and roads under the jurisdiction of the Minnesota Department of Transportation but would exclude the Interstate Highway System. 


MnDOT may require permitted municipalities to comply with additional conditions and restrictions, such as setting and enforcing appropriate traffic control measures designed to protect the safety of the traveling public and those individuals participating in outdoor dining activities. 


Food service businesses would be able to use the roads and street under DOT jurisdiction to create an outdoor dining area, including tables, chairs, and refuse containers.
